Reasons to Sue Your Employer During the Covid-19 Outbreak

People have unfortunately been forced into suing their employers during the Covid-19 pandemic. The most common reasons for these lawsuits are:

  • Being denied payment for overtime, hazardous duty, or meal and rest breaks.
  • Being denied payment for their work.
  • Their employer violating wage and hour laws while they are working from home.
  • Being fired for wearing PPE like gloves and facemasks.
  • Being fired for whistleblowing or speaking out about unsafe working conditions and a lack of safety procedures.
  • Being forced to work while sick.

The pandemic endangers us all, both physically and financially. It is immoral for these companies to put their profit over the wellbeing of their employees.

Coronavirus Wage and Hour Claims

Wage and hour claims have unfortunately been the most common during this pandemic. It is appalling that employers are not paying their employees for the work they have completed, for overtime, or for hazardous duty. If an employer requires their employees to work off the clock, this is also a wage and hour claim.

The above actions are in opposition to the Fair Labor Standards Act, thereby allowing employees to hold their employers accountable for rights violations.

While there have been many changes to the guidelines during the Covid-19 pandemic, the Department of Labor has released guidelines to help employers. Often companies that act without a thought for their employees’ wellbeing will use the excuse that they weren’t aware of the labor laws.

When to Sue Your Employer

If you’ve brought your concerns to management and they’ve been dismissed, ignored, or gotten you fired, then sometimes action is required.

Your family is suffering due to the immoral and illegal actions of your employer. After all your hard work and loyalty, you are unable to pay bills, may be risking your life unnecessarily, or have been fired.

There is a statute of limitations on how much time you have to file a claim against your employer, so the sooner you act, the better. If you miss the deadline, you will have lost your chance to bring a claim against your employer.

The time to act on your employer’s illegal action is now. You need to seek the advice of an employment attorney before your employer endangers the health of more employees and before they go bankrupt.
